1. Introduction

This Privacy Policy describes how AuClose LLC, a New Mexico limited liability company ("AuClose," "we," "us," or "our"), collects, uses, shares, and protects your personal information when you use the AuClose mobile application ("App") and related services (collectively, the "Platform"). By using the Platform, you agree to the practices described in this Privacy Policy. If you do not agree, do not use the Platform.

We are committed to transparency. This policy is written in plain language so you can understand exactly what data we collect, why we collect it, and who sees it.

2. Information We Collect

2.1 Information You Provide

  • Account Information. When you create an account, we collect your email address, username, and password (stored as a secure hash by our infrastructure provider — we never see or store your plaintext password).
  • Residential Address. During Trinity of Trust verification, you provide your residential street address, city, state, and zip code. We validate this address through a mapping service and convert it to a generalized geographic zone identifier (an "H3 cell" — a hexagonal area roughly the size of a neighborhood) for discovery purposes.
  • Listing Content. When you create a listing, we collect the photos, descriptions, dimensions, condition answers, and other information you provide about your item.
  • Transaction Data. We record information about your transactions, including bids placed, auctions won, prices, handoff confirmations, and Chip Rating feedback.
  • Communications. If you contact us at support@auclose.com, we retain the content of those communications.
  • Camera and Photo Library Access. To create an auction listing, the App requests permission to access your device’s camera and photo library. We collect the images you capture or select solely for the purpose of attaching them to your listings. These images are transmitted to and stored securely on our servers so they can be displayed to other Users on the Platform.

2.2 Information Collected by Third-Party Services

  • Biometric & Identity Data (Stripe Identity). During identity verification, Stripe collects a photo of your government-issued ID and a live selfie for biometric facial matching. AuClose does not receive, store, process, or have access to your raw biometric data, facial geometry, or government ID images. This information is collected and processed entirely by Stripe under Stripe's Privacy Policy. See Section 8 for additional biometric data disclosures.
  • Payment Information (Stripe). When you add a payment method, Stripe collects and stores your full card number, expiration date, and security code. AuClose never receives or stores your full card number. We store only: a Stripe reference identifier for your payment method and your card's last four digits (for display purposes only, e.g., "Visa ····4242").
  • Seller Financial Information (Stripe Connect). If you register as a seller, Stripe collects additional information required for its Know Your Customer (KYC) and anti-money laundering (AML) compliance, which may include your legal name, date of birth, Social Security Number (last 4 or full), and bank account details. This information is collected and stored by Stripe, not AuClose. Seller funds are held in your Stripe Connected Account under Stripe's banking licenses.

2.3 Information Collected Automatically

  • Device Tokens. If you enable push notifications, we store a device token provided by Firebase Cloud Messaging to deliver notifications to your device. This token identifies your device, not you personally.
  • Usage Data. We record certain platform usage events necessary for Karma scoring, including bid placement, auction outcomes, handoff timing, and payment events. We do not track your browsing behavior outside the App.
  • Location-Derived Data. Your address is converted to an H3 geographic zone identifier (resolution 8 — approximately a neighborhood-sized area). This zone identifier, not your raw GPS coordinates or street address, is used for listing discovery. We also use pre-calculated drive-time estimates between geographic zones to show you items that are nearby in terms of travel time.

2.4 Information We Do NOT Collect

We want to be explicit about what we do not collect or store:

  • Raw biometric data (facial geometry, fingerprints) — handled exclusively by Stripe
  • Government ID images — handled exclusively by Stripe
  • Full payment card numbers — handled exclusively by Stripe
  • Real-time GPS tracking or continuous location monitoring
  • Browsing history, cookies, or cross-app tracking data
  • Contacts, calendar, microphone, or other device sensors (beyond the camera, which is used only when you choose to take listing photos)
  • We do not run any third-party analytics, advertising, or tracking SDKs

3. How We Use Your Information

We use the information we collect for the following purposes:

  • Verification. To verify your identity, payment capability, and residential address as part of the Trinity of Trust.
  • Transaction Facilitation. To process bids, manage auctions, authorize and capture payments, generate Secure Pickup PINs, and facilitate handoffs.
  • Karma & Reputation. To calculate your Karma score from objective transaction events, award badges, and enforce behavioral accountability (e.g., bid caps for low-Karma Users).
  • Discovery. To show you listings that are nearby based on drive-time calculations using your H3 geographic zone — not your raw address.
  • Push Notifications. To send you transactional notifications (outbid alerts, auction results, payment confirmations, handoff reminders), account-related notifications (verification status, Karma changes, badge awards), and application updates. We may also send notifications promoting AuClose+ or other Platform features. You can disable push notifications through your device settings at any time.
  • AI-Assisted Listing Creation. When you create a listing, your selected item category is sent to Google Gemini to generate relevant condition questions. We do not send your personal information to Gemini — only the item category.
  • Search. Listing titles and descriptions may be processed into mathematical representations ("embeddings") to power the Platform's search functionality. These embeddings are derived from listing content, not personal data.
  • Platform Improvement. To monitor Platform performance, fix bugs, and improve features. We do not sell data or use it for advertising.
  • Legal & Safety. To enforce our Terms of Service, prevent fraud, and comply with legal obligations.

4. How We Share Your Information

4.1 With Other Users (Transaction Context Only)

When you participate in a transaction, certain information is shared with the other party:

  • Always visible: Your username, Karma score, and badge portfolio are visible on your public profile and listings.
  • After auction win: The winning buyer receives the seller's meetup location (residential address or designated public meetup point). The seller receives the buyer's username.
  • After handoff: Chip Rating feedback is associated with your username.

We never share: Your email address, full residential address (outside of a specific transaction), payment information, phone number, or raw location data with other Users.

4.2 With Third-Party Service Providers

We share information with the following third-party providers, each of which processes data under its own privacy policy:

4.3 We Do NOT Sell Your Data

AuClose does not sell, rent, or trade your personal information to third parties for advertising, marketing, or any other purpose. We do not participate in data broker networks. We do not serve ads. We do not allow third parties to pay for visibility or placement in the App.

4.4 Legal Requirements

We may disclose your information if required by law, subpoena, court order, or government request, or if we believe disclosure is necessary to protect the rights, property, or safety of AuClose, our Users, or the public.

4.5 Business Transfers

If AuClose is acquired, merged, or undergoes a change of control, your information may be transferred as part of that transaction. We will notify you of any such change and any choices you may have regarding your information.

5. Seller Fund Custody & Financial Data

AuClose does not hold seller funds. All seller earnings are held in your Stripe Connected Account under Stripe's banking licenses. When we display your "balance" or "earnings" in the App, we are showing data retrieved from Stripe's API — not from an AuClose-managed account. AuClose maintains an internal audit log of financial events (sales, fees, withdrawals) for your transaction history view, but the authoritative record of your funds is held by Stripe.

6. Location Data

6.1 What We Collect

We collect your residential address during verification. We convert this address to an H3 cell identifier at resolution 8 — a hexagonal geographic zone roughly the size of a neighborhood.

6.2 How Location Is Used

Your H3 cell, not your raw address or GPS coordinates, is used for discovery. When you browse listings, the Platform calculates drive time between your zone and listing zones using a pre-computed travel matrix. This enables "15 minutes away" style results rather than raw distance circles.

6.3 What Other Users See

Other Users see drive-time estimates to your listings (e.g., "12 min away"), not your address. Your residential address is disclosed only to the winning buyer of a specific transaction, and only after successful payment authorization, for the purpose of arranging pickup.

6.4 Server-Side Computation

Your H3 cell is computed on our servers, not on your device, to prevent location spoofing.

7. Data Retention

7.1 Active Accounts

We retain your account data for as long as your account is active. Transaction records, Karma ledger entries, and Chip Ratings are retained for the lifetime of your account to maintain the integrity of the reputation system.

7.2 Deleted Accounts

If you request account deletion (see Section 10), we will delete or anonymize your personal information within 30 days, except where retention is required by law or necessary for legitimate business purposes (e.g., financial records required for tax compliance, fraud prevention, or pending dispute resolution). Anonymized transaction records may be retained indefinitely for platform analytics.

7.3 Dormant Accounts

Dormant seller accounts follow the escalation schedule described in our Terms of Service (30-day nudge, 90-day email, 180-day warning, 365-day auto-payout). Account data is retained during this period.

8. Biometric Data Disclosure

8.1 Who Collects Biometric Data

AuClose uses Stripe Identity, a third-party service operated by Stripe, Inc., to verify User identity. As part of this process, Stripe — not AuClose — collects biometric identifiers and biometric information, including facial geometry derived from a live selfie and a government-issued ID photo.

8.2 AuClose's Role

AuClose initiates the verification session by directing you to Stripe's hosted verification interface. AuClose receives a verification result (verified or not verified) and a session identifier for audit purposes. AuClose does not receive, access, store, process, or transmit any biometric data at any point.

8.3 Purpose

The sole purpose of biometric data collection is identity verification to prevent fraud and ensure the safety of the marketplace.

8.4 Consent

Before the verification process begins, the App displays a disclosure explaining that Stripe will collect biometric data. You must affirmatively consent to proceed. You may decline, in which case you will not be able to complete verification or use listing and bidding features.

8.5 Retention & Destruction

Biometric data retention and destruction are governed entirely by Stripe under Stripe's Privacy Policy and Stripe Identity's documentation. AuClose has no control over and accepts no responsibility for Stripe's biometric data handling. Questions about biometric data retention should be directed to Stripe.

9. Data Security

9.1 Technical Measures

We implement security measures including: encrypted data transmission (TLS), database-level access controls (Row Level Security policies), server-side validation of all sensitive operations, separation of client and administrative access privileges, and secure server-side computation of sensitive data (location, verification status).

9.2 No Guarantee

While we take reasonable measures to protect your information, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security.

9.3 Your Responsibility

You are responsible for maintaining the security of your account credentials and for any activity under your account. Notify us immediately at support@auclose.com if you believe your account has been compromised.

10. Your Rights

10.1 Access

You may request a copy of the personal information we hold about you by contacting support@auclose.com.

10.2 Correction

You may update your account information through the App. For corrections to information you cannot modify directly, contact support@auclose.com.

10.3 Deletion

You may request the deletion of your account and associated personal data (including listing photos and profile information) by contacting support@auclose.com or by using the account deletion option within the App's settings menu. Deletion is subject to the retention exceptions described in Section 7.2.

10.4 Push Notification Opt-Out

You may disable push notifications at any time through your device's system settings. Disabling notifications will not affect transactional operations but may cause you to miss time-sensitive alerts (outbid notifications, payment deadlines, handoff reminders).

10.5 Biometric Data

Because AuClose does not collect or store biometric data, biometric data deletion requests should be directed to Stripe at stripe.com/privacy.

11. State-Specific Rights

11.1 California Residents (CCPA/CPRA)

If you are a California resident, you may have additional rights under the California Consumer Privacy Act and the California Privacy Rights Act, including the right to know what personal information we collect, the right to delete your personal information, the right to opt out of the sale of personal information (we do not sell personal information), and the right to non-discrimination for exercising your privacy rights. To exercise these rights, contact support@auclose.com.

11.2 Other States

Residents of other states with comprehensive privacy laws (including Colorado, Connecticut, Virginia, and others) may have similar rights. Contact support@auclose.com to make any privacy-related request.

12. Children's Privacy

The Platform is not intended for anyone under the age of 18. We do not knowingly collect personal information from children under 18. If we learn that we have collected information from a child under 18, we will delete that information promptly. If you believe a child under 18 has provided us with personal information, contact support@auclose.com.

13. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will update the "Last Updated" date and version number at the top of this document and notify you through the App. Your continued use of the Platform after such notification constitutes acceptance of the updated Privacy Policy.
